Share the Truth about Islam with everyone!

Assalamualaikum Warahmatullahi Wabarakatuh.

There will be those amongst you who would feel skeptical about such a title and ask ‘ How can I share with others about Islam when I myself do not know much about our faith?’

Am I right?

Many a times when I ask our fellow Muslims especially young Malay and Indian Muslims to explain about what Islam is, they go blank and say ‘I don’t know!’

Even the simplest of Surah’s such as Surah Al Ikhlas can’t be explained by these young persons that I feel so sorry for them. The key to solving all these problems has to be whether their parents had bothered to teach them about the Basics of Islam?

If we are asked by someone, ‘Please tell me what Islam is?‘ What do we share with them?

I would first get to know more about the person who is asking me these so I would be able to give them satisfactory answers that he or she can understand according to their level of intelligence and education.

We can’t simply assume anything about anyone. Appearances alone is not the yardstick to measure someone’s ability to understand what we are going to share.

At these times, people are exposed to all kinds of information derived from all types of sources. Information that can be true, false or even fabricated to look like they are authentic and the real McCoy!

What with the advent of fantastic developments in the field of Science and Technology, people can be easily duped and misled. So, we have to be really careful in dealing with our guests at the masjid or those whom we meet in our everyday life practically everywhere.

Answer them according to their level of thinking and understanding. Islam can be explained very simply or we can go into areas which at times can border on the very unimaginable realm. Especially in matters concerning the Ruuh @ Living Spirit ~ Life-force plus the Unseen Worlds of the Djinns and other beings.

Such matters can’t be explained or shown to others in any physical form. One experiences such encounters differently according to one’s own capabilities and  prevailing circumstances.

Hehehehehe. That’s getting too heavy, isn’t it? Hehehehe. Let’s go back to the basics.

I have to give you an example.

Let’s say that the questioner is a young male student. Malay. 18 years old. Hasn’t had any formal education about Islam and he practically doesn’t know squat about what his Islamic faith is all about?

He goes to the Masjid on Fridays and rays together with the congregation but it’s all a matter of doing as what others do by simply copying the actions and phrases uttered during Solat.

Remember that this is an EXAMPLE. A fictitious character. Not real. Imagined worst case scenario.

We can easily dismiss these type of ignorant Muslims as those who are Muslim by Birth but Ignorant @ Jahil by their upbringing. It’s not fair to label them as such but that’s the sad, stark reality of the matter.

But we can’t just let them be. You can’t just mind your own business and say to each their own.

On the authority of Abu Sa’eed al-Khudree (may Allah be pleased with him) who said: I heard the Messenger of Allah (peace and blessings of Allah be upon him) say, “Whosoever of you sees an evil, let him change it with his hand; and if he is not able to do so, then [let him change it] with his tongue; and if he is not able to do so, then with his heart — and that is the weakest of faith.” [Muslim]

Whether we realize it or not, we are all responsible for one another. We can’t afford to just save our own self’s but allow others to go to Hell. No sirree. We will be asked in the Hereafter as to why we did not help or guide the wrongdoers from remaining in Ignorance when Allah Subhanahu Wa Ta’ala had commanded us to:

You don’t have to be an Al Azhar University graduate or Scholar to share the basic Truth about Islam but you do have to have a certain level of intellect and knowledge in order to backup what you share with the facts based on the true authentic verses in the Qur’an or the authentic exact sayings of Prophet Muhammad Sallallahu Alaihi Wassallam.

Innovation and falsehood is forbidden to be used when sharing information about Islam with others. Instead of getting rewards in the Hereafter for sharing the Truth about Islam you do not want to end up in Hellfire for sharing falsehood which you conjured up out of your own imaginations.

May Allah protect us from such a state. Do not add or subtract from what has already been taught to us by Rasulullah Sallallahu Alaihi Wassallam. Stick to the basics. If you do need to give an example in order to simplify matters, please be sure not to cut out the essence and just offer up nonsense.

Islam can be explained in the simplest of terms yet many choose to add unnecessary interpretations of their own that they end up confusing not only their own self’s but others in the process.

Prophet Muhammad Sallallahu Alaihi Wassallam spent 13 long years in Makkah just preaching that ‘There is no other god but Allah!’

 

That was the essence of his Message. Once you realize and believe in Allah, the only One Supreme God who is our Creator and embed this fact deep in your heart, then you go on to attest that Muhammad is the Final Messenger of Allah.

We pray and submit ourselves only to Allah and it is only Allah that we worship. We do not worship Prophet Muhammad. We love and respect Allah’s Greatest and Final Messenger with all our heart but we do not pray to him. We follow his Sunnah @ the Examples of Muhammad but we do not worship or venerate him.

This is the true Essence of our Faith. May we be blessed and guided by Allahu Rabbul Alamin that we get to live our lives as righteous, knowledgeable and truthful Mukmins and be saved from ending up in the Hellfires come Doomsday.

Reviving the Spirit of Ramadan by Ustaz Hazrizal Abdul Jamil

It is indeed a lonely battle. Perhaps a slow process to adapt to all the new routines. No more ‘Ustaz Hasrizal, no more sermons in the mosque, and no adhaans even from the minarets of mosques to signify that is it time to pray. Living in Europe is not something new to me. Six years of living in the UK and Ireland, more than a decade ago, exposed me to many unique experiences, but none like what I am experiencing currently, as a Muslim in Northern Scandinavia, 200 km south of the Arctic Circle.

Halal food is very limited. We eat mainly home cooked food. Performing basic devotional acts like the five daily prayers is challenging enough. In December and January, we had the shortest Zuhr time, as short as 9 minutes, while Fajr prayer commenced when I was in the middle of the second lecture of the the dark and freezing (subzero-temperatures) morning. This new surrounding has really forced me to relook at what I understand about Fiqh in Islam and has given me a new appreciation of the dynamism of the Shariah which serves to help Muslims practise Islam without difficulty, no matter how odd the context they live in.

It is not only about me and my wife but more importantly, our children. They are also dealing with a new environment. Their understanding about Islam and being Muslims is challenged to the core. They are not only questioned by peers from time to time, but our children themselves have many questions to ask.

Rarely do they ask HOW questions these days. There are many books written to answer these questions. Under the Finnish education system, they also receive religious education at school, specifically about Islam. From time to time, HOW questions are answered and modeled in class.

Most of the time, thinking intrinsically about Islam has led them to ask WHY questions. Something beyond HOW, even WHEN and WHAT. The WHY questions require us to understand Islam, beyond do’s and don’ts, questions which we do not think about as often as we should. It is this lack of depth in the understanding of religion that gave rise to the magnum opus Ihya’ ulum al-din, “Revival of Religious Sciences”, of the great scholar of Islam, Abu Hamid al-Ghazali (1058 – 1111). It is only by answering WHY questions can our practice of Islam have an effect on our souls, values and hence give meaning to the rituals we perform as religious people.

This small book was written almost a decade ago. It invites the readership to simply think but not think simplistically, how Ramadan in reality is a help from Allah to aid us better ourselves. Ramadan entails fasting, prayer, recitation of the Quran, giving charity and making amendments. Ramadan brings about physical, intellectual, emotional and social benefits stemming from spiritual strength. It is that spiritual strength that links rituals with meanings, and the actions of the servant with the judgment of his Lord.

I wish for my children to read this book in the language of their study and social life. My wife too always reminds herself and me the need to assess from time to time our children’s understanding and appreciation of Islam. Thus, the translation of this book is timely, as a fulfillment of that wish and need. This translation, will not merely be a gift from a father to his kids as a learning tool on how to adapt to life in Finland, but it is an endeavor to share the knowledge and experience in the original book with a wider audience.

I wish to thank my friend, Aqtar Mohamed Ummar who kindly offered to translate this book. The friendship and understanding which has developed between us for a long time has been of great value in helping him to translate what I wish to convey in the book. Our history began once upon a time with me speaking and him listening, and as fate would have it, we now work together under one roof in Khalifah Model School Secondary (KMSS), aspiring to provide a good education to future generations. It is hoped that this book marks the beginning to more synergies in the future.

I also wish to thank my friend Ahmad Shakir Salleh and Ariff Jauhar Iskandar from Abideen Books for their great effort and commitment in getting this translated copy published. Your efforts culminating in the publication of this book have helped to convert thoughts and words into a reading material which will help spread knowledge and goodness. May Allah reward us all with goodness in this world and the Hereafter.

Let us revive Ramadan by asking, WHY, so that the answer to that question will help us increase our faith and hope, in being granted good by Allah, as Rasulullah (PBUH) promised:

“Whoever observes fasts during the month of Ramadan out of sincere faith, and hoping to attain Allah’s rewards, then all his past sins will be forgiven.”

We are all reeling from the shock of another mindless and uncalled for terrorist’s attack in the UK by those who are said to have shouted ‘In the Name of Allah’ as they drove a van into the crowd of innocent passersby at London Bridge and then jumped out and stabbed 6 people and wounded countless others in the aftermath.

As expected, the media frenzy erupts once more with accusing fingers pointing to Islam and Muslims for we have now become the favorite scapegoats for the deviant criminal actions of the mindless few radicalized lunatics who are born and bred in the UK itself.

No where in Islam does Allah call for this type of senseless killings or encourage Believers to go harm others without due cause!

In the last decade or so after World War 2, Islam and Muslims have sort of been replaced as the desired scapegoats by the Western world in lieu of the Soviet Union and Communism. The reality of a disfranchised Muslim world where differing Muslim majority countries have been at loggerheads with each other, the Western Imperialist and Colonist powers such as the USA and Britain together with certain European Union leading countries have taken a strong position against those who profess the Islamic faith and stepped up efforts to demonize the world’s fastest growing religion.

They are also quite eager to invade and occupy the oil rich Middle Eastern countries who are ruled by leaders who often bicker and quarrel over the slightest issue and differences between them.

We all also know that the 2001 September 11th tragedy which brought down the World Trade Center twin towers in New York, United States of America was an inside job orchestrated by the US Federal Government of President George W.Bush Jr. as evidenced by the numerous proofs and evidences exposed by the American scientists and building structural experts and main media channels themselves.

Saudi Arabia which is the Muslim world’s wealthiest nation and where Islam’s two holiest sites are located , namely Makkah al Mukarramah and Madinah al Munawwarah, ought to have taken the lead to be the real legitimate Caliphate for the world’s Muslims but chose to seclude itself and instead aligns itself to the United States of America which in actuality is the patron and main supporter of ISIS/ISIL.

Today, Saudi Arabia severed diplomatic ties with Qatar giving the excuse that Qatar supports terrorism. Neighboring countries like the UAE, Bahrain, Yemen and Egypt followed suit and severed all ties with Qatar as well.

Isn’t this just stupid? The Zionist rogue regime of Israel surely will be reveling  at this turn of events for now they can easily go in and cause more instability to the Arab world by their covert programs through the Israeli Mossad, the American’s CIA and Britain’s M15 and M16 operations.

In the meantime, the radicals and terrorists would be having a field day carrying out more attacks upon the unsuspecting countries and claim to do so ‘in the Name of Allah!’ They willingly smear the good name and reputation of Islam and Muslims in their fake unfounded ‘jihad’.

Muslim countries can’t afford to just be bystanders and watch this rot take place. There should be a United Muslims International Force to go all out and destroy these terrorists once and for all. No efforts should be spared in exterminating these Khawarij who are behind the current dilemma which we the Ummah of Muhammad Sallallahu Alaihi Wassallam are facing as a result of their treachery.

Reports are also coming in that this latest attack is but a ‘false flag’ attack planned and unleashed by the powers that be themselves as part of their ‘New World Order’. Who can deny this?

Ramadan ~ Sacred month of Fasting, Worship or Gluttony?

Assalamualaikum Warahmatullahi Wabarakatuh!

Dear Ikhwanul Muslimin na wal Muslimat, Mukminin na wal Mukminat, especially those of you living here in Malaysia.

Would you agree with me that over the years, Ramadan here in Malaysia has slowly but surely been getting too commercialized! What with the trend of many in focusing more on trading food and other festive goods at the Ramadan bazaars?

Usually, it’s shop till you drop!

What a shame!

From my observance of such acts over the years, many of such Muslims here in Malaysia tend to prioritize their business efforts in this one month more than focusing on worshiping Allah Subhanahu Wa Ta’ala as they should?

Such a trend could be attributed to the individual’s personality and character? Whether one is a practicing Muslim or just in name? Those who practice their faith would obviously know how to go about their acts of faith and know how to allocate the needed time for their worship of Allah and time to do their business?

But I have yet to come across any such Ramadan Bazaars that allocate some suitable prayer space for both the traders and the teeming crowds of people frequenting the various stalls to buy their iftar needs.

Ramadan is the exclusive month in which we as Muslims ought to intensify our acts of worship towards Allahu Ta’ala and get the special blessings provided which Allah promises to reward us with in the Hereafter absolving us of our sins and entering us into His Paradises yet here we are so busily engaged in gluttony and earthly commerce forgetting the bountiful rewards promised to those who are heedful of His Commandments.

The Prophet Muhammad Sallallahu Alaihi Wassallam forbade us from overeating when we break our fast. His Sunnah @ Example when breaking fast was to eat a few dates and a drink of water.

After breaking his fast, the Blessed Messenger of Allah performed his Maghrib prayers in congregation. We are encouraged to observe and follow His Sunnah in all that we do but sadly, in these times and age, quite a number of Muslims tend to go overboard when breaking fast and eat like there’s no tomorrow.

I came across a photo that shows a man who gorged himself silly with food till he could only lie on his back with a huge bulging belly! Clearly this borders on Haram for definitely we will be unable to perform our ibadah if we end up like this!

May Allah protect us from such a state! Ameen.

Do not keep on eating just because others are doing so. They are ignorant of the prohibition by the Prophet not to do so. Please do not be foolish and stuff yourselves silly in congregation with them.

Ramadan is the month where all the evil Syaitan, Djinns and Iblis are chained and locked up in the Hellfire’s but the habits of some of us from amongst the Ummah tends to just continue what the Accursed enjoined and practiced.

So, who do these folks want to blame for their transgressions? The Devil and his accomplices are not around in the whole month of Ramadan. We have no one else to blame but our own self’s.

We need to observe the Do’s and Don’ts of Ramadan. I will share more with you in the next article. Insya Allah.

We all know that the world’s more than a billion Muslims are not all so perfect or free from committing sins or mistakes just like every other human being here on Earth. Apart from the fact that we testify that ‘There is no God save for Almighty Allah and attesting that Prophet Muhammad Sallallahu Alaihi Wassallam is our Lord’s Final and Greatest Messenger to His Entire Creation, each of us lives and will eventually breathe our last when our time is up.

Each of us differs from one another by our social, cultural and economic status and live as we see fit or according to our own individual personal circumstances. The way we practice our faith depends on our own personal acquired knowledge and our level of commitment to what we profess or claim to be.

There are ups and downs in one’s level of Belief and our practices of Islam varies from time to time as we go about our daily lives. We are currently living in what has been described as the End of Time. The Last Ages. Akhirul Zaman. The Age of Fitnah. Age of Tribulations.

We have before us Science and Technology that would only be regarded as pure wizardry by those who lived and died before us if it was presented to them back then. Unimaginable inventions, devices, telecommunication capabilities available that emperors and kings would willingly pay handsomely to acquire if it was available back in the Dark Ages.

As Muslims we believe in the Creation of Our Father Sayyidina Adam Alaihis Salam by Almighty Allah Himself in the most perfect of form and imbued knowledge plus the Faculty of Reason by God Himself and do not subscribe to the Theory of Evolution conjured up by the likes of Charles Darwin and those like him.

We are all descendants of Prophet Adam Alaihis Salam and Our Mother Sayyidatina Hawwa Radhiallahu Anha and turned into different tribes returning to our Origin back to the essence from which the various parts of the earth was collected from this planet which was collected by Sayyidina Izra’il Alaihis Salam, one of the mightiest Angels @ Malaikats of Allah when Allah commanded him to do so in order to create Adam up there in the highest heavens.

The very significant attribute that differentiates us from the other Creation of Allah is that we have been given the Freedom of Choice and Willpower to choose what we wish to believe in and what we feel like doing at times without realizing the consequences of our actions but most of these times fully aware of the results but just don’t bother or care of its ramifications!

There are times when we just don’t even fear God even though we know that He is Most Aware and not a jot escapes His Knowledge as well as the monitoring of us by Allah’s Malaikats @ Angels. Some say ‘So What?’ and continue with their desires and urges disregarding any pleas or cries for mercy!

It is true that we can be the ‘Best of Allah’s Creations and also the Worst! Even animals won’t do what quite a large number of human beings are doing to each other! Even to this very second, there are billions of innocent victims out there suffering as a result of human wickedness and barbarity! Regardless of their social standings or position in life! I coined a phrase before that ‘Even Alims @ The Knowledgeable Ones can turn into Zalims @ the Evil Doers’!

After Adam Alaihis Salam came a myriad of 124,000 Prophets and Messengers from Allah to continue guiding Mankind back to the Fitrah @ Nature of submitting to Allah’s Will and Commandments. There was scripture after scripture revealed to Mankind to believe in Allah and live as per His Commands but verily Mankind is a stubborn lot.

There are those amongst us who are recalcitrants and continue to wreak havoc amongst our fellow Mankind what more against the helpless other Creations of Allah who are powerless or ill equipped to face up to the onslaught of some human’s penchant for indulging in utter vice, debauchery and willful savagery!

In the shocking video above, some brave documentary makers have exposed the shocking reality of pedophilia that is ravaging the lives and future of hundreds of thousands of innocent young boys who despite being born and raised in a supposedly Muslim country!

These !@#$%^& Laknatullah’s @ Cursed by Allah are destroying over half a million and more innocent young Muslim children by committing these dastardly and forbidden acts of sodomy of street living homeless boys as young as 7 years old and the so called Islamic Government of Pakistan choose to ignore their plight and have not taken action against the pedophiles rampaging all over their major cities of Peshawar, Rawalpindi and Karachi not forgetting the entire country that shamelessly puts up an Islamic front as its national symbol.

What’s the point of trumpeting to the entire world that they are a nuclear powered formidable country if they can’t even defend and protect the honor and dignity or innocence of their very own young citizens such as the boys featured in the documentary above?

Too busy fighting against the fictitious or self created enemies of Islam and ‘Pakistan Zindabad‘ when your own pedophiles are sodomizing your future heirs to an early death! What the bloody hell is wrong with you??? Where are your damn priorities?

What kind of Muslims are you when despite knowing that Sodomy and Homosexuality is HARAM in Islam, you conveniently choose to CLOSE BOTH EYES and CHOOSE NOT TO SEE or bother to nip all these savagery in the bud?

Where there’s a will definitely there will be a way to stop and eradicate all these nonsense!

It’s all up to you.

Prophet Muhammad Sallallahu Alaihi Wassallam himself warned against allowing this abominable act to prevail amongst his ummah yet to this very second or moment hundreds if not thousands of young boys are being raped at will by the bus drivers and truckers over there in Pakistan!

This has been going on for quite long now that people are protesting!

Not to say that this does not happen elsewhere or even here in Malaysia where I live but not to this extent over there in Pakistan where in the documentary it proved that social welfare officers have found that 9 out of 10 interviewed homeless street children said that they have been raped almost daily with no one coming to their aid!

People can scream and shout in protest all they want worldwide but if no real action is taken to stop these child abuses right there in Pakistan and worldwide, it will continue to fester and destroy the lives of these victims.

I implore those authorities in Pakistan if they come to read this to repent and stop this evil from continuing to smear and destroy the country’s reputation. Please stop the rot!

How do you feel being pushed down from a 24 story building? I answered: I feel free.
How do you feel when you are left on your own searching for the meaning of life and quest for knowledge? I answered: I feel free.
How do you feel being an immigrant? I answered: I feel free.
Then the person said: But why my friend???
Aren’t you feeling, depressed, frustrated, hurtful and fearful???
I really really don’t understand you!!! Do you still want to be a Muslimah?
What about your children, aren’t they a load?
See what Islam has done to you? Are you really happy?Can you please tell me why before your studying months end???
Finally I just smiled and answered: Of course I am deeply hurt, no one can deny it as I am a normal person but I really really feel the freedom through submitting to God.
Yes, of course, I still want to be a Muslimah and I am still learning to feel the serenity, strength and beauty of freedom living in God’s realm because Islam has set me free…
The Quran is my life-jacket, the Prophet and his companions are my inspiration; my children are my lighthouse and of course, I am happy.
I am the happiest Mommy in the world and you, my dear friend, you will understand me the moment you feel what true freedom means in Islam; and you will feel free from depression, frustration, hurt and fear because God will set you free..

MARIA DETAINED UNDER SOSMA, WHY NOT? by Jee Abdullah

When our Inspector-General of Police (IGP) Khalid Abu Bakar disallowed Bersih 5 rally to proceed, no one in the Bersih 2.0 steering committee or the opposition leaders took notice to ensure that they abide by Section 10 (C) and Section 11 of the Peaceful Assembly Act 2012, that is to get approval from Dataran Merdeka owner, the Mayor.

The police have also reminded numerously, should Maria Chin and Bersih 5.0 are adamant to go ahead on their targeted date 19 November to hold their gathering in Dataran Merdeka without the PAA’s requirement, then they should realised that they did not meet legal provisions and hence violated the stipulated Act. Tell us which part that these so called law experts and law abiding people in Bersih 2.0 steering committee are unable to understand?

Therefore, Bersih 5.0 rally is illegal. So when Maria Chin is detained under the Security Offences (Special Measures) Act 2012 or SOSMA, why the need to dispute it?

As stated clearly that Bersih 5 is an illegal rally, the green light from Maria Chin and her steering committee to proceed is thus encouraging to go against in maintaining public order and the people safety. The police is correct to carry out instructions to stop illegal Bersih 5 rally when it is obvious detrimental to the security of our nation.

Should any opposition leaders questioned PM Najib’s assurance that SOSMA will not be affecting on politicians, they ought to proof that Maria Chin have held any position in any political party, then SOSMA should not be imposed on he her. If Maria Chin is merely a political instrument, as chairman of an NGO that has violated the laws that have threatened the public order, then SOSMA is very appropriate and she is a threat to our nations’ security.

If the oppositions needed to be reminded that Maria is chairing an illegal rally “which is prejudical to public order in, or the security of, the Federation or any part thereof ;”. Her detention is thus necessary to stop action as stipulated in SOSMA when she has initiated “to procure the alteration, otherwise than by lawful means, of anything by law established”.

As a seasoned political watchdog, Ambiga should have extensive legal knowledge affecting illegal assembly that the police in no way are liable to facilitate them and what more to ensure participants safety. But her statement to demand for the police presence is as though very obligated, not only that she is misleading public opinion but in fact she is inviting the police too to be unlawful.

What Ambiga should have done as a former chairman for Bersih 2.0 steering committee is to advise Maria Chin and her people to fully comply with the Peaceful Assembly Act (PAA) procedures and abide by rules and regulations as stipulated under the PAA. Instead she has chosen to incite to condemn the police that they are denying the illegal Bersih 5 rally rights to a peaceful assembly. Is Ambiga a truthful and an apt watchdog?

The keywords to Maria’s SOSMA detention are ‘agreeing and allowing’ to be manipulated by certain opposition leaders as a coup instrument. Unless Maria and her Bersih activities detached themselves from these group of usupers, their demands may stay applicable.

She needs no one to blame except the unscrupulous politicians and in particular Dr Mahathir and Kit Siang for ill-advising her. The vigil in solidarity with her is not enough to correct the situation as Maria has to be on her own to face charges for all the wrong reasons to satisfy those villainous opposition leaders. But… you asked for it Maria!

MCA was limped and had to rely on pro UMNO Malay voters in small margin Malay dominated constituencies for many years since GE12 (2008). Sadly with the latest MCA objecting to RUU 355 (Syariah law which only covers Muslim in this country) MCA is signing its own death warrant

To many betrayed Muslim voters, MCA is more ignorant that DAP. While the latter enjoyed undivided support of Chinese community in Malaysia, MCA latest political miscalculation on Syariah issue that touches the nerve of every Muslim and makes Muslim give undivided support irrespective of their political ideologies means one thing- MCA can no longer enjoyed the immunity of being categorised as Muslim friendly ” kafir zimmi.”

Thus today MCA is at par with DAP, kaffir harbi

For DAP, no matter what may be the outcome of RUU 355 today, they have the undivided support of the Chinese community. Hence DAP can steadily brace for next election and still win handsomely from the Chinese community.

Contrarily for MCA,who have been borrowing political lifeline from Muslim population/voters , this means the demise of MCA in the next General Election

I do hope PM strategists read the outcome of today’s event and be prepared for one thing- Please be smart and do not field MCA candidates or BN will lose miserably in next GE.

Attack on increased jurisdiction of Syariah courts unconstitutional and an affront to religious liberty by Azril Md.Amin

June 1 — The Centre for Human Rights Research and Advocacy (CENTHRA) reads with deep concern the joint statement by the Joint Action Group for Gender Equality (JAG) with regards to the Private Member’s Bill tabled by YB Dato’ Seri Haji Abdul Hadi Awang, Member of Parliament for Marang seeking to amend the Syariah Courts (Criminal Jurisdiction) Act 1965 (Amended 1984) to enable the increase of punishments meted out by the Syariah courts (Increasing powers of Syariah Courts may lead to rights violations, MalaysiaKini, 31 May 2016).

We note that the joint statement contains several factually inaccurate assertions as well as downright false and misleading claims, not to mention baseless accusations regarding the proposed Bill in particular, as well as the administration of criminal justice by the Syariah judiciary in general, which we feel compelled to address as well as redress, if only to put in proper perspective the issues surrounding this debate, considering, to borrow the statement’s own words, the level of debate this has generated in the public sphere.

First of all, the implied claim by JAG that the tabling of the Private Members’ Bill was undemocratic, not transparent and should have been subjected to public consultation is unwarranted and illogical given that in a Westminster-based constitutional system such as ours, such a move is not practical given the time constrains involved. We remind JAG that the Bill is not based on any proposal or legislative programme but a Private Members’ Bill, and duly elected Members of Parliament are free to bring forth Bills before the chamber of the House they were elected to without subjecting the same to any consultation process, especially given that the prerogative of whether such Bills are approved for tabling lies with the Speaker of the House. In the United Kingdom House of Commons, for example, hundreds of Private Members’ Bills are presented for tabling for every session and if all such Bills were to require public consultation prior to their tabling then parliamentary business would never be finished. We believe that the confusion took place because such Private Members’ Bill was the first kind of its nature in the history of our Parliament.

Secondly, with respect to the so-called “Malaysian interpretation” and the absence of guarantees in the way Syariah-sanctioned whippings are administered in other countries, we point out that the Bill is tabled before the Parliament of Malaysia, and if passed would become law in Malaysia. As such, sheer logic alone necessarily entails that the “Malaysian interpretation” would most definitely apply, regardless of the practice in other countries, which has absolutely no bearing on this matter whatsoever. JAG has also failed to adduce any example or evidence where present Syariah laws have been applied in a discriminatory fashion leading to victimization.

Regarding the role of the state in enforcing the precepts of Islam, we again remind JAG that this is sanctioned by no less the Constitution itself, which by virtue of Article 4(1) thereof, is the nation’s highest law. Article 3(1) of the Constitution states that Islam is the religion of the Federation. This is to be read with Schedule 4 of the Constitution containing the oath of the Yang di-Pertuan Agong (YDPA) pursuant to Articles 32 and 37 thereof, which mandates that the YDPA must at all times protect the religion of Islam and uphold the rule of law. This reading is further fortified by the Herald’s Case [2013] 8 CLJ 890 which states that Article 3 is no mere declaration, but imposes a “positive obligation” on the Malaysian State to protect, defend and promote Islam and its injunctions by appropriate state action, which necessarily includes conferring already existing Syariah courts with the necessary jurisdiction to carry out the injunctions of Islam.

Lastly, JAG should be chastised for making more baseless claims that increasing punishment places a temporary bandage on open wounds, causes more societal harm in the long run and is not in accordance with the compassionate and merciful nature of Islam. It is trite that any criminal justice system, and not just one based on Islam, is meant to subject perpetrators of crimes to justice, and not just the restorative sort but also of the retributive as well as preventive kind as well. While we concede there are existing weaknesses in administration that may lead to abuse, it is submitted that this may be dealt with effectively by taking into account their presence with a view to rectifying the same, and not by simply doing away altogether with a criminal justice system based on Islam, which is the religion of the majority of the population, and more so one that has existed in this land since ancient times prior to the introduction of the British inspired civil criminal justice.

Indeed doing so would lead to degradation of human rights, and erode in particular the religious liberty of citizens professing the religion of Islam, which is specifically protected by Article 11(1) of the Constitution, and is wholly incompatible with the goal of upholding human rights in Malaysia.

Akhie Naim ~ Respons kepada Aisyah Tajudin

Rasanya ramai yang tidak setuju atau tidak sanggup pun dengan hukuman ‘bakar’ atau ‘rogol’ terhadap Aisyah, gadis BFM yang bodoh itu. Cuma, kita kena faham bahawa kata-kata kesat dan ancaman kasar terhadap Aisyah itu datangnya daripada perbuatan Aisyah sendiri. Jangan salahkan mereka yang marah itu. Mari kita ubah sedikit senario untuk memahaminya;

Katakan ada seseorang yang normal (bukan orang gila) menghina ibu kita. Cukup dengan kata-kata: “Wey, mak kau bodoh sangat kenapa?”

Sebagai seseorang yang normal, apakah kita akan:
A) memukul orang itu
B) memarahi atau menghina kembali orang itu
C) bersabar dan berlapang dada
D) tersenyum sahaja dan memaafkan orang itu

Saya rasa, semua orang yang normal akan bertindak mengikut pilihan A atau B. Betul?

Kenapa? Kerana maruah. Apabila seseorang yang mulia di sisi kita, dalam contoh di atas ibu kita, dihina dan dicerca maka sudah tentu sifat marah dalam diri kita akan bangkit – dan ini bukan sikap yang keji tetapi terpuji kerana dengan marah itulah kita akan mampu mempertahankan kemuliaan.

Dalam Islam, setiap satu yang wujud ada kedudukannya yang tersendiri. Orang bukan Islam tidak akan mampu memahami hal ini kerana susunan seperti ini tidak ada dalam agama mereka. Dalam Islam, kedudukan Allah, Rasulullah dan para ulama itu tertinggi, lebih tinggi daripada ibubapa kita sendiri, lebih tinggi daripada professor universiti atau bekas professor universiti.

Maka, jika ibubapa (atau anak) kita dihina kita marah, TERLEBIH WAJARLAH apabila Allah, Rasulullah atau para ulama dihina kita marah.

Kalau kau mempertahankan kata-kata kau atas dasar “freedom of speech”, maka kau tidak boleh salahkan aku kalau aku kata: “Mak dan bapak kau bangang eh?”. It’s “freedom” of speech, isn’t it…
